Laws Pertaining to Public Access Defibrillators

U.S. H.R. 2428 Title IV: Cardiac Arrest Survival Act
This federal law provides immunity to good Samaritans who use defibrillators and the employers who obtain them. Employees must be trained.

California A.B. 2041
This federal law provides immunity to good Samaritans who use defibrillators and the employers who possess them. Employees must be trained and certified. Medical oversight by a physician must be provided on an ongoing basis.

Good Samaritan Law
The federal Good Samaritan Law provides immunity to citizens who assist others in an emergency in good faith.

Community AED Law
The Community Automated Electronic Defibrillator Law encourages private companies and public agencies to purchase defibrillators and train employees on their use. This federal act is intended to improve the cardiac arrest survival rate; it cites the survival rate without an onsite defibrillator is approximately five percent, but the survival rate with an on-site defibrillator is approximately seventy percent.

California A.B. 1145
This state government act is an urgency statute stating that all state run businesses be mandated for the implementation of a Public Access Defibrillation Program. In order to provide immediate assistance to persons in state-owned or state-leased buildings who might otherwise die or suffer severe injury from cardiac arrest, at the earliest possible time, it is necessary that this act take effect immediately.
